Outdoor-Adventure-Day-Waiver/Release-of-Liability-Agreement

1.-Acknowledgment-and-Assumption-of-Risks-

1.1.-Acknowledgment-of-Potential-Risks-

I-(“Participant”)-hereby-acknowledge-that-my-participation-in-the-Outdoor-Adventure-Day-at-Rocky-Ridge-Park-(“Event”)-involves-inherent-risks,-including-but-not-limited-to-(a)-the-dangers-of-hiking,-nature-walks,-and-outdoor-recreation,-(b)-adverse-weather-conditions,-(c)-exposure-to-wild-animals,-insects,-and-poisonous-plants,-(d)-potential-physical-injuries,-(e)-death-and/or-property-damage.-I-understand-and-voluntarily-assume-all-risks-associated-with-my-participation-in-the-Event.

2.-Waiver-and-Release-of-Liability-

2.1.-Scope-of-Released-Claims

In-consideration-of-the-opportunity-to-participate-in-the-Event-and-any-services,-facilities,-and-equipment-provided,-I,-for-myself-and-my-personal-representatives,-heirs,-assigns,-and-next-of-kin,-fully-and-forever-release,-waive,-and-discharge-Rocky-Ridge-Park,-its-owners,-officers,-directors,-shareholders,-agents,-employees,-volunteers,-successors,-assigns,-and-any-other-participants,-sponsors,-advertisers,-and-if-applicable,-owners-and-lessors-of-any-premises-used-during-the-Event-(collectively-as-“Releasees”)-from-any-and-all-liabilities,-claims,-demands,-damages,-negligence,-costs,-losses,-or-expenses-resulting-from-or-arising-out-of-my-participation-in-the-Event.

2.2.-Indemnification

I-agree-to-indemnify-and-hold-harmless-the-Releasees-from-any-and-all-liabilities,-claims,-demands,-damages,-negligence,-costs,-losses,-or-expenses,-including,-without-limitation,-attorney's-fees-and-expenses,-arising-out-of-or-relating-to-my-participation-in-the-Event,-including-but-not-limited-to-any-claims-arising-out-of-my-own-negligent-acts-or-omissions,-or-those-of-other-participants,-employees,-agents-or-volunteers-of-the-Releasees,-or-any-of-their-activities-during-the-Event.

3.-Participant-Responsibilities

3.1.-Compliance-with-Rules-and-Regulations

As-a-Participant,-I-understand-that-I-am-responsible-for-my-own-safety-during-the-Event-and-for-observing-and-obeying-all-rules,-regulations,-and-instructions-given-by-Event-organizers,-staff,-or-the-management-of-Rocky-Ridge-Park.-I-acknowledge-that-failure-to-comply-with-any-such-rules,-regulations,-or-instructions-may-result-in-my-expulsion-from-the-Event-and-forfeiture-of-any-fees-paid.

3.2.-Health-and-Physical-Condition

I-represent-and-warrant-that-I-am-in-good-health,-physically-fit,-and-able-to-safely-participate-in-the-Event.-I-understand-that-it-is-my-responsibility-to-consult-with-a-physician-prior-to-my-participation-in-the-Event-and-to-inform-Rocky-Ridge-Park-of-any-medical-condition-that-may-affect-my-ability-to-participate-safely.-I-agree-to-assume-all-risks-related-to-my-participation-in-the-Event,-and-I-hereby-consent-and-authorize-any-medical-treatment-deemed-necessary-by-a-qualified-medical-professional-in-the-event-of-injury,-accident,-and/or-illness-during-my-participation-in-the-Event.

3.3.-Personal-Property

I-understand-that-I-am-responsible-for-my-own-personal-property-during-the-Event,-and-I-agree-to-assume-all-risk-of-loss,-damage,-or-theft-of-my-personal-property.-The-Releasees-shall-not-be-liable-for-the-loss,-damage,-or-theft-of-my-personal-property-while-participating-in-the-Event.

4.-Governing-Law-and-Jurisdiction

This-Agreement-shall-be-governed-by-and-construed-in-accordance-with-the-laws-of-the-United-States,-without-regard-to-conflict-of-law-provisions.-Any-disputes-arising-from-this-Agreement,-including-those-relating-to-my-participation-in-the-Event,-shall-be-resolved-exclusively-in-the-courts-of-the-United-States.

5.-Binding-Effect

This-Agreement-is-binding-upon-and-shall-inure-to-the-benefit-of-the-parties-hereto,-as-well-as-their-respective-heirs,-personal-representatives,-executors,-administrators,-successors,-and-assigns.-My-participation-in-the-Event-constitutes-acceptance-of-the-terms-and-conditions-set-forth-herein.

6.-Severability

If-any-provision-of-this-Agreement-is-declared-to-be-invalid,-illegal,-or-unenforceable,-the-remaining-provisions-shall-be-unaffected-and-shall-continue-in-full-force-and-effect.-I-expressly-agree-that-this-waiver-and-release-shall-be-construed-as-broadly-as-permitted-under-the-laws-of-the-United-States.

7.-Entire-Agreement

This-Agreement-constitutes-the-entire-agreement-among-the-parties-hereto-with-respect-to-the-subject-matter-hereof-and-supersedes-any-and-all-prior-agreements,-understandings,-and-representations,-whether-written-or-oral,-with-respect-to-the-subject-matter-hereof.

By-signing-below,-I-acknowledge-that-I-have-read,-understood,-and-voluntarily-accepted-the-terms-and-conditions-of-this-Waiver/Release-of-Liability-Agreement-for-the-Outdoor-Adventure-Day-at-Rocky-Ridge-Park.
